Gale (on phone) “ They have signed a lease for the land and have paid for one year. They are working with the engineers to put the plans together. The plans have to be approved by the FAA. It is supposed to be done by the end of this year.”

    Information Only: Update on Airport EMS and Fire Management, the Airport Crash Unit (ARFF) and basic response with the new White Pine County and City of Ely Interlocal Agreement.

Gale: “With the Interlocal Agreement the County has with the City, the City will respond to any happenings at the airport. We have an agreement between the County and the City, for the City to use the ARFF. I am in a meeting right now with the FFA, going over our Airport Response Plan. Now that is it’s under the City, all of the information has to be approved again by the FFA. Now all that information has to be recorded in our Airport Response Plan. Now we have to take all of the County’s information out and put the City’s information in.”

Parish: “Do we know if they have anyone ARFF certified?”

Gale: “That’s part of the process so, when I get back I need to meet with the City and then get back to the FFA. One of the things that I have to do is to make sure that our Interlocal Agreement meets with all of the FFA requirements. If it doesn’t, then we have to tweak that a little bit.

We think that by the end of this year, the people in Elko will have their ARFF Center available. There’s a possibility we can send people from Ely or other people to get recertified. Going to Elko will have a huge expense savings.”

     Update on Airport Capital Improvement Projects

Gale: “Because of our weather, the projects have been put back to the 19th through 20th of June. Our next areas of improvement will be the South ramp and it seems to be coming in under budget at $64,000. A company out of Utah will do this project at the end of July. It will take seven to eight days to complete.”

Discussion “Day at the Airport” Events

Three of our donors to the Air Races would like us to keep their donations for other uses ( about $6,000 .) So we have several thousand dollars that we can use for “Day at the Airport”. The date of a Day at the Airport will be September 7th. Gale will be contacting people with unique airplanes, the committee will be looking for someone who serves food and do entertainment.

     Update on Airport Weed Project on June 7th, 2019 at 6:30 a.m.

The airport will need at least ten volunteers, these volunteers can also be people that needs to complete  their community service.

    Report on Airport Award (FAA Stakeholders Award).

The Western Pacific Region ( Nevada, Arizona, California, Hawaii and Alaska), we were selected as one of the top Airports in our region this year, for the improvements that our airport and how we have handled our airport improvement Project,  and how we have handled our grant procedures. This is a pretty prestigious award. Only three airports have been recognized and we are the top. Gale will be receiving this award today on behalf of White Pine County. Gale will be presenting the award to the County Commissioners at their next meeting.

    Update / Report from the Commission liaison 

Bybee “ As far as the ARFF training goes, we are working with the City and as soon as they get their hiring levels up, we plan on assisting in getting ARFF training done. If the ARFF Center in Elko is up and running that would be fine. We are fully intending on helping them get someone to the training in Texas.”

    Report from the Airport Manager

Gale “ We have been get given permits to take care of the antelope. NDOW have given us permit for the antelope and geese. It’s going to be a tough year because of all the rain we had, it makes the airport very attractive for grazing. The antelope will continuously butt their heads into the fence until they break it loose. 

    Last week a pilot had to fly low over the airport to get them off the Runway.”

Gale “When the FFA and NDOT was here last week, we went to the hospital and have a meeting. The plans are to put a heliport pad near the hospital. Matt Walker the CEO of the hospital, will be making a presentation to the hospital board. The pad is planned in the Park area just south west of the hospital.”

The next meeting date will be July 2, 2019

Ely City Council May 23, 2019

Public Comment 

John Gianoli address the Council regarding the settlement between the City of Ely and the S&S Shortline Leasing. “Haste makes waste.” He felt this agreement would allow the S&S Short Line to take over the Northern Nevada Railway. NRS chapter 268 is real simple regarding lease and sale of property. It needs to go out to bid, there is definitely interest. I think the City needs to put this out to bid that the best for the community. 

Other people also agreed with Gianoli.

Letter representing Edgar Investments, requested that this item be tabled or denied.

Mark Bassett stated that the agreement was poor and should not be followed through with. He reminded the Council of the meeting on May 5th, they wanted the Georgetown Ranch property to go out to bid. He stated essentially the City was trying to sell one rail 128 miles long. The other rail is owned by the foundation and we are not interested in selling. If the City accepts this offer from S&S they will be receiving $0.26 on the dollar.

Chachas felt that any decision on the railroad should be left to the new City Council.

Mayor VanCamp – attended an event,  approved a liquor license and a meeting at the college.

The Mayor also invited everyone to the celebration for Memorial Day put on by the VFW.

The Mayor also stated some of her memories from her wild ride as Mayor. She did thank Jennifer Lee for her efficiency and the manner in which she conducted business. The City Attorney was also thanked for his efficiency and attention to detail. The Mayor went on to thank all the people that she had worked with.

Public Hearing 

    Discussion/For Possible Action  – Consideration of an application for reclassification of property zoning. The applicant wishes to rezone the property from the current M2 Zone (Heavy Manufacturing District) to an R– 1 – 50 Zone (Residential District). The general location of the property is 18th Street north of Avenue M in Ely, Nevada. The applicant is White Pine County Commissioners.

Chachas stated he was against the rezoning.

Odgers stated that the Planning Commission was in favor of this, they would like to have a 200-foot buffer zone between the business and any residential areas.

Carson wanted to know how many lots this will be broken up into, the reply was 14. There are about 14 Lots in that area that are privately owned, why does the County want to go down this Avenue at this time? He suggested that we should not be building new homes at this time.

Hanson stated that we are short on housing at this time, so we do need to start building.

Carson replied, how can you say that there are 14 lots of available?

Hanson replied the problem is getting people to build on those lots. I do like your idea of tearing down the older dilapidated houses that we do have. We are looking at new businesses that may need as many as 500 employees. We need something built and ready for them.

Odgers explain that this would not be the final document, there are other details coming to complete the final document. As to those people who feel this would be illegal, I do not feel they are correct. This has nothing to do with the historical Railroad.

Agreement – the S&S will pay the City $150,000 for all legal damages. The dismissal will resolve all claims by both sides regarding the past and future amounts due under the lease agreement / joint development agreement. The city will assign S&S all its of its rights in the subject lease agreement / joint development agreement.

S&S and the City will enter an agreement to lease all of the land the City owns under what has been referred to as “Nevada Northern Railway”. The lease will be for 99 years at $50,000 / year. This early amount will stay consistent for years one through five of the lease. For years six through ten, the yearly rate will increase 1% and the yearly lease payment will increase to $50,500. In your 11-15, the payment will increase in additional 1% to $51,005. In year 16, the parties will meet to discuss the cost adjustment to the yearly amount of the lease for the next 5 years.

This is a framework for negotiating finer points, Carson was very interested in how this procedure would proceed. By the time we’re finished this document will most likely be 50 or 60 pages long. Will we get to a point of disagreement?

Litigation will continue to move forward even though we are in a settlement stage. If we need to go back before a judge, we will do that. There will be a final document that has to come before the Council.

Hanson stated that it was fine this was over and we stopped hemorrhaging money in the courtroom.
