With a new licensed cannabis retail store that recently opened in the City of Ely, I would like to once again go over the laws that regulate the use of marijuana.
1. You must be 21 years of age or older to purchase, possess, or use marijuana.
2. You may only possess 1 ounce or less of marijuana, or 1/8 of an ounce of marijuana concentrate.
3. You must be 21 years or older to possess related items of paraphernalia used to ingest marijuana.
4. Smoking or consuming marijuana in a public place is illegal
5. Smoking or consuming marijuana in a vehicle is illegal
6. Smoking or consuming marijuana in a retail store is illegal.
7. You may transport marijuana in a vehicle, not to exceed 1 ounce or 1/8 of an ounce of concentrated marijuana.
8. It is against the law to operate a vehicle while under the influence of marijuana.
9. You may not smoke marijuana in the presence of children.
10. You cannot smoke marijuana and be in possession of a firearm.
One of the biggest changes that now goes into effect since the new store has opened up is that you can no longer have personal cultivation in your home. In other words you can no longer grow marijuana in your home or any other place. There is an exception to this law, and that is if you have a medical marijuana card or live 25 miles outside the radius of the retail store. If you fall under that exemption then you are allowed to have a maximum of twelve plants growing in your home for personal cultivation.
